HomeOwners Terms & Condition

This Service Agreement (“Agreement”) is entered into between you the Homeowner (“Homeowner,” “you,” or “your”) and Yardu Inc. (“Yardu,” “we,” “our,” or “us”) and governs your access to and use of Yardu’s services and mobile application (the “App”) to request, schedule, and receive services from third-party independent service providers (“Providers”).

By using the Yardu App or booking a service through our App, you agree to the following terms:

A. Purpose of Agreement

Yardu provides a digital App to connect Homeowners with independent Providers for home-related services, such as lawn mowing and snow removal and other approved services (“Services”). Yardu does not provide the Services itself but facilitates your access to them.

B. Homeowner Responsibilities

You agree to:

  • Provide accurate, complete, and up-to-date information when creating your Yardu account and scheduling services.
  • Select the most appropriate service type that best matches your property and the most appropriate nature of the work.
  • Ensure that the service location is safe, accessible, and compliant with local laws and regulations.
  • Be present (or arrange for an authorized adult to be present) at the time of service, if required.
  • Treat Providers with respect and refrain from engaging in abusive, inappropriate, or unlawful behaviour.
  • Pay all fees associated with booked services according to the pricing and payment terms provided through the Yardu App.

C. Yardu’s Role

  • Yardu acts as a facilitator and intermediary between you and Providers.
  • We do not employ the Providers; they are independent contractors responsible for their own equipment, insurance, and work quality.
  • Yardu vets Providers and offers Homeowner support but is not responsible for the conduct or performance of any individual Provider.

D. Restrictions on Personal Contact and Solicitation

To maintain a safe and professional environment for all users you agree to:

  • Not solicit, offer, or engage in direct transactions with Providers outside of the Yardu App.
  • Not request or share personal contact information (including phone numbers, email addresses, social media handles, or home addresses) with Providers.
  • Not attempt to hire or engage Providers for services independent of the Yardu app.

E. Service Bookings and Cancellations

  • Bookings can be made through the Yardu app and are subject to Provider availability.
  • You are required to consult the appropriate sections of the app or website to ensure that the service you are booking most closely matches your property and the nature of the work.
  • Homeowners may cancel their requests at anytime. However, cancellation of a request by a homeowner after such request has been accepted by a service provider would be subject to an administrative fee equivalent to 5 percent of the pre-tax amount charged for the service.

F. Payments and Fees

  • All payments are received through the Yardu app. Yardu uses a secure third-party payment processor.
  • You authorize Yardu to charge your preferred payment method for all applicable fees, including service costs, applicable taxes, and cancellation fees.

G. Damage and Liability

  • In the event of property damage or service dissatisfaction, you must report the issue to Yardu within 24 hours of the service completion.
  • Yardu will investigate the claim and, at its discretion, may facilitate resolution with the Provider.
  • Yardu is not liable for indirect, incidental, or consequential damages or losses, and our total liability is limited to the amount paid by you for the affected service.

H. Account Suspension or Termination

Yardu reserves the right to suspend or terminate your account if you:

  • Violate this Agreement or our Terms and Conditions of Service;
  • Abuse, harass, or endanger Providers;
  • Submit fraudulent or false claims;
  • Breach payment obligations;
  • Persistently submit misinformation about the type of property or nature of the work.

I. Privacy and Data Use

Your use of the App is subject to Yardu’s Privacy Policy, which describes how we collect, use, and protect your personal information.

J. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Canada and applicable laws in the province where the service is provided. Any dispute arising out of or in connection with this Agreement shall be resolved through mediation and then arbitration (if necessary) in Canada in accordance with the applicable rules.

K. Amendments

Yardu may update this Agreement from time to time. You will be notified of significant changes, and continued use of the App constitutes acceptance of the revised terms.

BY PROCEEDING TO USE THE YARDU APP OR BOOK SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS SERVICE AGREEMENT.

Service Provider Terms & Condition

This Service Agreement (“Agreement”) is entered into by and between Yardu Inc., a company registered under the laws of Canada (“Yardu” or “Company”), and the Service Provider (“Service Provider” or “Contractor”), whose details are provided in the application form.

By accepting the terms of this Service Agreement through the Yardu app, the Service Provider agrees to the terms set forth in this Service Agreement.

A. Definitions

  • Service Provider: An individual or entity approved and registered by Yardu to provide services through the Yardu app.
  • Service: Any services provided by the Service Provider through the Yardu app, including, but not limited to, lawn mowing, snow clearing, or other related services as requested by homeowners on the Yardu app.
  • Indemnified Party: Yardu, including its officers, directors, employees, agents, affiliates, and representatives.
  • Homeowner: The individual or entity requesting the service through the Yardu app.

B. Obligation to Provide Service

Any Service Provider who accepts a homeowner’s service requests becomes obligated to provide the accepted service at the date and approximate time specified in the request. If after accepting a service request, the Service Provider discovers that they are no longer able to provide the service, they must visit the Yardu app and decline the request preferably no later than three hours to the specified time of service.

C. Payment Processing and Refund

  • Payment to Service Provider: Payment to the Service Provider will be processed only after Yardu has determined that the service has been provided satisfactorily, in compliance with the terms and conditions of the service request.
  • Refund to Homeowner: Yardu reserves the right to withhold payment to the Service Provider and refund the corresponding payment to the Homeowner under the conditions listed below.

D. Conditions to Withhold Payment

  • Failure to Provide Service: If Yardu determines that the requested service was not provided at all to the Homeowner, Yardu has the right to withhold payment to the Service Provider and refund the full payment to the Homeowner.
  • Insufficient Service Provided: If Yardu determines that the requested service was insufficiently provided, Yardu has the right to withhold payment and refund a portion or all of the payment to the Homeowner.
  • Homeowner Complaint: If the Homeowner files a complaint with Yardu regarding the unsatisfactory performance or non-performance of the service, and Yardu confirms the complaint to be valid, Yardu has the right to withhold payment and refund the Homeowner.

E. Investigation and Determination

Yardu will conduct an investigation to assess the validity of the Homeowner’s complaint. The Service Provider will be notified and given an opportunity to provide their explanation, evidence, or other relevant information. Yardu will make a final determination and may withhold payment depending on the level of service provided.

F. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Canada in the province where the service is provided. Any dispute shall be resolved through mediation and then arbitration (if necessary) in Canada.

G. No Exchange of Personal Information

The Service Provider shall not provide any personal information such as phone numbers, email addresses, social media handles, or physical addresses to the homeowner. All voice calls, messages and text messages between the Service Provider and the homeowner must occur through the Yardu app.

H. Suspension or Termination of Account

Yardu reserves the right to suspend or terminate the account of a Service Provider if it determines that the Service Provider has violated any part of this Service Agreement or if it deems such suspension or termination to be necessary for the effective investigation of a homeowner complaint or issue.

BY PROCEEDING TO USE THE YARDU APP OR ACCEPT SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS SERVICE AGREEMENT.

Parent Guidelines

This Parental/Guardian Consent (“Consent”) is made and entered into on Date: ___________________ between Yardu Inc. (“Yardu”) and the undersigned parent or legal guardian (“Guardian”) of the minor identified below (“Minor”).

1. Acknowledgment of Terms

The Guardian acknowledges that:

  • The Minor, Full Name of Minor: __________________________________, age ________, wishes to register and participate as a Yardu Service Provider through the Yardu app.
  • The Yardu Terms and Conditions of Service for Service Providers (“Terms of Service”), as updated from time to time, apply to all service providers, including the Minor.
  • The Guardian has reviewed the Terms of Service and agrees to them on behalf of the Minor.

2. Consent to Participation

The Guardian hereby consents to the Minor’s participation as a Yardu Service Provider, including but not limited to:

  • Accepting and completing service requests from Yardu customers,
  • Using Yardu’s platform and resources,
  • Receiving notifications from Yardu, and
  • Receiving payments for completed services through Yardu’s payment system.

3. Assumption of Responsibility

The Guardian agrees to assume full responsibility for the Minor’s obligations under the Terms of Service, including but not limited to:

  • Compliance with Yardu’s safety regulations and service standards, service agreement, privacy and data use policy, and app use policy.
  • Responsibility for property damage, personal injury, or third-party claims arising from the Minor’s services.
  • Indemnifying Yardu, its affiliates, directors, officers, and agents against any claims, liabilities, or expenses resulting from the Minor’s participation as a Service Provider.

This document must be signed by a parent or legal guardian before a minor can be approved as a Yardu Service Provider. Contact Support@Yardu.Ca to submit this form.
